Motor Rove Terms of Service
1. Agreement and Acceptance
By using Motor Rove’s platform (website or app), you agree to be bound by these Terms of Service. These Terms form a binding contract between you and Motor Rove (a brand of BeamFlex Media, Nairobi, Kenya). If you do not accept these Terms, you must not use our services. Your continued use of the platform indicates your consent to these Terms.

Original Work: Any news articles, reviews, videos, or other content you upload or publish on Motor Rove must be your original creation. You must have the rights to the content you post (including images, text, and music). You are legally responsible for ensuring that your content complies with all applicable laws (intellectual property, defamation, privacy, etc.) and with these Terms.
Compliance: You agree not to upload or share illegal or disallowed material. For example, knowingly publishing false or misleading information online is a crime under Kenya’s Computer Misuse and Cybercrimes Act. Motor Rove strictly prohibits defamatory, harassing, hateful, sexually explicit, violent, or otherwise illegal content. If your content violates any laws or these rules, you will be solely responsible, and Motor Rove may remove it and terminate your account.

You will indemnify and hold Motor Rove harmless from any claims, costs, or damages (including legal fees) arising from your content or your violation of these Terms.
6. Content Restrictions and Rules
Unless we give written permission, you may not:
Reproduce, broadcast, sell, or create commercial products from any content on Motor Rove without authorization.
Copy, adapt, reverse-engineer, or republish our platform’s code or data.
Remove copyright, trademark, or other proprietary notices from any content.
Misrepresent or impersonate others, or use bots/scripts to generate traffic.
Engage in fraudulent practices (for example, generating fake clicks to inflate article views or ad impressions). Any attempt to manipulate traffic or ad metrics will result in suspension or banning.
7. Affiliate Links and Promotions
If you include affiliate links or promotions in your content (for example, links that earn you a commission on product sales), you must clearly disclose this relationship to readers. All promotional content must follow Motor Rove’s editorial rules and Kenyan advertising laws. You must not use misleading tactics to promote products or links. Articles with undisclosed or inappropriate affiliate marketing may be rejected or removed. Note: Motor Rove does not guarantee any income or payment from affiliate links or promotions — you bear the risk of how well your content performs.
8. Ownership and License of Your Content
You retain ownership of any original content you submit. However, by uploading content to Motor Rove, you grant us a perpetual, worldwide, royalty-free, sublicensable license to use, display, distribute, and otherwise exploit your content on our platform and through our channels. Your content is not confidential, and you cannot claim any compensation or royalties for Motor Rove’s use of it beyond any agreed payment terms. You agree not to enforce any confidentiality or proprietary rights over content you upload.
9. Independent Contractor Status
Contributors, writers, and affiliates on Motor Rove are independent contractors, not employees or staff. You provide services to Motor Rove under a contract for services. This means you are responsible for your own taxes and statutory contributions, and you are not entitled to any employee benefits (such as paid leave or payroll deductions). You do not have the authority to bind or represent Motor Rove beyond the scope of these Terms. Kenyan law recognizes freelancers as distinct from employees, so please ensure you report your income and comply with applicable tax obligations.
10. Content Exclusivity and Conduct
Your contributions to Motor Rove should not be published elsewhere (offline or online) without our written approval. While you own your content, we require an exclusive period for publication on our platform. You must not mislead readers or publish non-original work. Motor Rove reserves the right to review and remove any content at our discretion.
11. Payment and Remuneration
If Motor Rove chooses to pay you for content (based on our earnings or ad revenue policies), such payment is at our sole discretion and under our published remuneration guidelines. We do not guarantee any payment or revenue for your contributions. Payments, if any, will follow the policy in effect at the time of payment, and we may update that policy at any time. We may refuse or reverse payments if your content violates these Terms or damages Motor Rove’s reputation. If your account is terminated for non-compliance, you will forfeit any pending payments.
12. Termination and Enforcement
Motor Rove may suspend or terminate your access to the service at any time and for any reason (for example, content violations or fraudulent activity). We are not liable to you or anyone else for any action we take under this section. If you violate these Terms or engage in illegal activity, we may terminate your account and report you to law enforcement. For instance, publishing false information online is illegal under Kenyan law and may be referred to authorities. We reserve all rights to enforce these Terms and cooperate with legal authorities as required.
13. Disclaimers and Liability
Motor Rove provides the service “as is” and makes no warranty of any kind. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise (including warranties of merchantability or fitness for a particular purpose). Motor Rove is not responsible for the content of user submissions or for any losses that arise from using the service. To the fullest extent allowed by Kenyan law, Motor Rove’s total liability to you for all claims under these Terms is limited to a nominal amount (for example, up to the equivalent of USD 50.00). We are not liable for any indirect, incidental, or consequential damages (like loss of data or income) even if advised of the possibility. If you disagree with these Terms or disclaimers, your only remedy is to stop using Motor Rove.
14. Intellectual Property Rights
All trademarks, logos, and brand names on Motor Rove (including the “Motor Rove” name and stylized logos) are the property of Motor Rove or its licensors. You may not use or display any of our trademarks without prior written permission. If you see any unauthorized use of our trademarks, please notify us.
15. Communications and Updates
By creating an account, you agree that Motor Rove may send you service-related communications (such as updates about new features or policies). All such communications will comply with Kenyan law and our Privacy Policy. You may opt out of marketing communications by contacting us directly, but you cannot opt out of essential service messages (such as account or payment notices).
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of Kenya. You agree that any dispute arising from or relating to these Terms will be resolved under Kenyan law. Any disputes not settled amicably will be brought exclusively before the courts (or arbitration) in Nairobi, Kenya. Nothing in these Terms prevents Motor Rove from seeking injunctive relief in any jurisdiction if necessary to protect our intellectual property or confidential information.
17. Changes to These Terms
Motor Rove may modify or update these Terms at any time.
